LIABILITY WAIVER AND RELEASE AGREEMENT

Local Tire Change

This Liability Waiver and Release Agreement (“Agreement”) is entered into by and between the undersigned (“Customer”) and Local Tire Change(“Company”). By signing this Agreement, the Customer acknowledges the potential risks associated with seasonal tire swaps and agrees to release the Company from any and all liability.

Acknowledgment of Risks: The Customer acknowledges that there are inherent risks associated with the seasonal tire swap, including but not limited to damage to tires, rims, or the vehicle itself.

Assumption of Risk: The Customer assumes all risks, known and unknown, arising from the seasonal tire swap performed by the Company.

Release and Waiver: The Customer hereby releases, waives, and discharges the Company, its agents, representatives, employees, and any other persons acting on its behalf from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Customer or the Customer's property, whether caused by the negligence of the Company or otherwise, related to the seasonal tire swap.

Indemnification: The Customer agrees to indemnify, defend, and hold harmless the Company from any and all claims, lawsuits, damages, or losses the Company may sustain as a result of any claim brought against the Company by any person or entity arising from the seasonal tire swap.

No Guarantees: The Company makes no guarantees or warranties, express or implied, regarding the results of the seasonal tire swap.

Entire Agreement: This Agreement contains the entire agreement between the parties and supersedes any prior understandings, written or oral, relating to the subject matter of this Agreement.

Amendment: This Agreement may only be amended in writing and signed by both parties.

Governing Law: This Agreement shall be governed by and construed under the laws of the Ottawa/Ontario.

Acknowledgment: The Customer acknowledges that they have read this Agreement, understand its terms, and voluntarily sign it. The Customer further understands that by signing this Agreement, they waive certain rights and assume certain responsibilities.
